This Service Agreement governs your use of the Online Banking website to check the status, review and submit information, and facilitate your loan application with Bank of America, N.A. (Bank of America). The information provided on this website is not a commitment to lend. Credit and collateral are subject to approval. Terms and conditions apply and are subject to change without notice. We do not charge a fee for accessing this website.
B. Relation to Other AgreementsYour use of the website may also be affected by agreements between you and Bank of America for accounts relating to an application. This Service Agreement does not change the agreements you may already have with us for any such account. Nor does the Service Agreement change any other agreement you may have with us relating to any other products or service you may access from Bank of America by electronic means, such as, for example, the Online Banking and Transfers Outside Bank of America Service Agreement and Electronic Disclosure. You should review those other agreements for any applicable fees, and for terms associated with your use of any such account product and/or service.
2. Registration and Upload of InformationYou will be required to register in order to access and use the website. In accessing the website, you may also upload information relating to your application. For registration and uploads, you represent and warrant that all such information is accurate, true, current, and complete as of the date it is provided to us by means of the website.
3. Other Terms and Conditions A. ModificationsWe may change this Service Agreement at any time. For example, we may add, delete or amend terms or services. Continued use of the website after the effective date of the change will constitute your agreement to the change.
B. CancellationYou will be able to access the website until such access is terminated by you or Bank of America. You may cancel your access – and this Service Agreement - at any time by notifying us of your intent to cancel in writing, or by contacting Online Banking customer service at 1.800.933.6262. This cancellation applies only to your access of the Online Banking website for your loan application pursuant to this Service Agreement.
We may terminate your access to the Online Banking website and this Service Agreement in the event of the cancellation of your loan application or for any reason, including inactivity, at any time. We will try to notify you in advance, but we are not obliged to do so.
C. Contact by Bank of America or Affiliated PartiesNo Bank of America employee will contact you via email or phone requesting your Online ID or passcode. If you are contacted by anyone requesting this information, please contact us immediately.
D. Disclosure of Account InformationWe may disclose information to third parties about you or your application in the following instances:

E. Disclaimer and Limitation on Our LiabilityThe Online Banking website is provided on an "as is" basis. We disclaim all representations and warranties including those pertaining to fitness for a particular purpose, or that the website will operate free from error or in an uninterrupted fashion.
Under no circumstance shall Bank of America be liable to you or any third party for any direct, indirect, incidental, special or consequential damages, however caused and of any kind (including physical or emotional damages), related to the website, whether arising under this Service Agreement or otherwise, even if we were advised of the possibility of such damages. Your sole and exclusive remedy hereunder shall be for you to discontinue use of the website. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply and you may have additional rights.
